Purpose
The provider, responsible for the website, makes this document available to users in order to comply with the obligations set forth in Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), as well as to inform all users of the website about the terms of use.
Anyone who accesses this website assumes the role of user, committing to the strict observance and compliance with the provisions herein, as well as with any other applicable legal provisions.
The provider reserves the right to modify any information that may appear on the website, without the obligation to give prior notice or inform users of such changes, the publication on the provider’s website being understood as sufficient.
Liability
The provider is exempt from any type of liability arising from the information published on its website, provided that such information has been manipulated or introduced by a third party unrelated to the provider.
The provider’s website may use cookies (small information files sent by the server to the computer of the person accessing the page) to carry out certain functions considered essential for the correct operation and visualisation of the site. The cookies used on the website are, in any case, temporary and have the sole purpose of making subsequent transmission more efficient, disappearing at the end of the user session. Under no circumstances will cookies be used to collect personal information. Cookie Policy.
From the client’s website, it may be possible to be redirected to third-party website content. Since the provider cannot always control the content entered by third parties on their websites, the provider assumes no responsibility for such content. In any case, the provider states that it will proceed to the immediate removal of any content that may contravene national or international legislation, morality or public order, proceeding to the immediate removal of the redirection to said website and informing the competent authorities of the content in question.
The provider is not responsible for the information and content stored, including but not limited to, in forums, chats, blog generators, comments, social networks or any other medium that allows third parties to publish content independently on the provider’s website. However, and in compliance with Articles 11 and 16 of the LSSI-CE, the provider makes itself available to all users, authorities and security forces, collaborating actively in the removal or, where appropriate, blocking of all content that may affect or contravene national or international legislation, third-party rights, or morality and public order. Should the user consider that there is any content on the website that may fall into this classification, they are requested to notify the website administrator immediately.
This website has been reviewed and tested to ensure it functions correctly. In principle, correct operation can be guaranteed 365 days a year, 24 hours a day. However, the provider does not rule out the possibility of programming errors or circumstances of force majeure, natural disasters, strikes or similar events that make access to the website impossible.
Intellectual and Industrial Property
The website — including but not limited to its programming, editing, compilation and other elements necessary for its operation, designs, logos, text and/or graphics — is the property of the provider, or the provider holds an express licence or authorisation from the rightful authors. All website content is duly protected by intellectual and industrial property regulations and registered in the relevant public registries.
Regardless of the purpose for which they are intended, total or partial reproduction, use, exploitation, distribution and commercialisation require prior written authorisation from the provider. Any unauthorised use by the provider will be considered a serious breach of the author’s intellectual or industrial property rights.
Designs, logos, text and/or graphics belonging to third parties and that may appear on the website belong to their respective owners, who are responsible for any controversy that may arise regarding them. In any case, the provider has the express prior authorisation of said owners.
The provider expressly DOES NOT AUTHORISE third parties to redirect directly to specific content of the website; in all cases, they must redirect to the provider’s main website.
The provider recognises the corresponding industrial and intellectual property rights of their respective owners. Their mere mention or appearance on the website does not imply the existence of any rights or liability of the provider over them, nor any endorsement, sponsorship or recommendation on the part of the provider.
For any observations regarding possible breaches of intellectual or industrial property rights, as well as regarding any website content, the user may do so via the email address provided in the identification data at the beginning of this document.
Accuracy of Information
All information provided by the User must be truthful. To this effect, the User guarantees the authenticity of the data communicated through the forms for the subscription of the Services. The User shall be responsible for keeping all the information provided to the Company permanently updated so that it corresponds, at all times, to the User’s real situation. In any case, the User shall be solely responsible for false or inaccurate statements and for the damages caused to the provider or third parties.
Minors
For the use of the services, minors must always obtain prior consent from their parents, guardians or legal representatives, who are ultimately responsible for all acts carried out by minors in their care. Responsibility for determining the specific content to which minors have access lies with these individuals; therefore, if minors access inappropriate content on the Internet, mechanisms must be installed on their computers — in particular, software, filters and blocks — that allow limiting the available content. Although not infallible, these are especially useful tools to control and restrict the materials minors can access.
Obligation to Use the Website Properly
The User undertakes to use the Website in accordance with the Law and this Legal Notice, as well as with morality and good customs. To this end, the User shall refrain from using the page for unlawful or prohibited purposes, harmful to the rights and interests of third parties, or that may in any way damage, disable, overload, deteriorate or impede the normal use of computer equipment or documents, files and any kind of content stored in any of the provider’s computer equipment.
In particular, and by way of example but not limitation, the User agrees not to transmit, disseminate or make available to third parties information, data, content, messages, graphics, drawings, sound or image files, photographs, recordings, software and, in general, any kind of material that:
(a) is contrary to, disparages or violates the fundamental rights and public freedoms recognised constitutionally, in international treaties and other current regulations;
(b) induces, incites or promotes criminal, defamatory, violent actions or, in general, actions contrary to the law, morality or public order;
(c) induces, incites or promotes actions, attitudes or discriminatory thoughts based on sex, race, religion, beliefs, age or condition;
(d) is contrary to the right to honour, personal or family privacy, or the image of individuals;
(e) in any way harms the credibility of the provider or third parties; and
(f) constitutes unlawful, misleading or unfair advertising.
Applicable Law and Jurisdiction
For the resolution of all disputes or issues related to this website or the activities carried out therein, Spanish legislation shall apply, to which the parties expressly submit, and the Courts and Tribunals of Madrid shall be competent to resolve any conflicts arising from or related to its use.
